FTC: 'Natural Cures' author in contempt
Posted: Friday, September 14 at 03:28 pm CT by Bob Sullivan
TV pitchman and best-selling author Kevin Trudeau is once again in the legal crosshairs of the Federal Trade Commission.
His new book, “Weight Loss Cure ‘They’ Don’t Want You to Know About,” is already on best-seller lists, but the FTC says Trudeau's advertising for the book is misleading and violates a court order prohibiting him from deceiving consumers in infomercials.
"In each of these infomercials Trudeau misrepresents that his protocol is easy and once completed, users can eat everything they want yet still maintain their weight loss,” the agency said in a legal brief filed Thursday in U.S. District Court in Chicago. “Contrary to these claims, his book’s weight loss program is arduous and requires severe food restrictions."
The FTC is asking the court to find Trudeau in contempt for violating the previous court order.
David Bradford, Trudeau's personal lawyer, defended the advertisement on Friday, saying the FTC's lawsuit is "without basis."
"The advertising has been airing for many months. There are no complaints about it," Bradford said. "There are no consumers’ complaints of any consequence that we're aware of."
He said the Trudeau has a First Amendment right to say anything he wants in the book, and by extension, in the infomercial.
"Whether he's right or wrong is for the public to decide, not the government," he said.
Trudeau has a long history as an infomercial salesman, and as a legal adversary of the FTC. He was sued by the agency in 1998 and again in 2003. A 2004 order settling charges that he falsely advertised the use of coral calcium as a cure for cancer banned Trudeau from appearing in infomercials, but included an exception for book advertisements. But the order specifically prohibited Trudeau from misrepresenting book content, and the FTC argues that is what he is doing in his current TV ads.
Kevin Trudeau
"Trudeau is once again demonstrating his disregard for court orders by making blatant misrepresentations about the ease and restrictiveness of the protocol described in his weight loss book in violation of the current Permanent Injunction," the FTC said.
Trudeau is best known for his prior book, "Natural Cures ‘They’ Don't Want You To Know About," which the author claims sold millions of copies.
Trudeau began hawking his new book on TV in December, the FTC said. His infomercial was among the top 10 most frequently aired long-form ads in February, March and July, it said.
The FTC's legal challenge hinges on Trudeau's claim in the ads that the weight loss program is "easy" and requires "no deprivation."
The book describes a three- to six-week regimen that requires the dieter to take daily injections of a prescription drug not approved for weight loss use by the FDA, the FTC said. Readers are also told to stick to a 500-calorie-per-day diet.
“Trudeau’s book describes a four-phase protocol that is a far cry from the infomercials’ promise of ‘the easiest method known on planet Earth. Indeed, the weight loss plan revealed in the book is hardly easy, mandating such onerous requirements,” the FTC alleged.
The FTC said that in addition to seeking a contempt of court finding, it will pursue "consumer redress."

I remember the first Natural Cures book. I thought there were some good ideas, but a lot of the rest of it seemed borderline paranoid and wierd. Glad to see it's just gotten worse.

500 calories a day? YIKES.

When will people learn that there is no easy answer to weight loss. It's sad that he (Kevin) makes money off of others.

Look, give the guy credit, he has created the perfect scam:
1. Offer something everyone wants.
2. Make it IMPOSSIBLE to follow the plan.
3. When the victim, er, customer fails, blame him/her.

Yeah, Kevin has been pushing every snake oil remedy under the sun. Finally he smartened up and started printing books which is protected by the first amendment. But surprise surprise, if you order the book online you will also get charged for a monthly newsletter.

With all the “diet pills” & “diet books” in the market that make false or misleading claims, why is Kevin being pursued so vigorously. Could it have anything to do with the influential Pharmaceutical companies?
(Sent Sep 14, 2007 4:34:16 PM)
My sister tried this "diet". I can't even begin to tell you how AWFUL she looked. For one, after 2 weeks she still hadn't lost a pound and her normally clear skin was all broken out and she had fever blisters on her lips.... If that is what it takes to be "thin"...I'll be fat thank you.
(Sent Sep 14, 2007 4:35:52 PM)
One pound = 3500 calories. Eat 500 less per day than you burn for seven days and you lose one pound that week. Eat 1000 calories more per day than you burn and you'll gain two pounds. It's just too bad we are so much better at addition than subtraction.

Um, Dave? Just about everyone makes money off of others. If we didn't we'd all toil in our gardens hoping to raise enough food to survive of the winter. Making money off of others is the cornerstone of civilization. As for the gullible? We can't be everybody's mommy and prevent them from spending their money unwisely. After people do it enough they learn their lesson - and if they don't, nothing the government can do will stop them from making bad financial decisions.

Kevin Trudeau is a LOSER!! I accidentally happened onto one of his late night hypes when he was pushing coral calcium. I about laughed my socks off at the silliness of it all until I realized that people were really going to take him seriously and shell out a lot of money. The horsedrawn wagon and the bottle with the cork in it is gone, but the "tonic" salesman lives on.

He's easily the most visible of these charlatans doing this stuff - that's why he's attracting attention, not because of some conspiracy. Like some huge company is really worried about a guy on late night infomercials...

Jon Ande, Seattle, Wash (Sent Sep 14, 2007 4:46:56 PM)
The guy is a snake oil salesman who's been pushing the limits of law and violating the spirit of consumer protection for years. It's not that his books mislead - in fact most of the information he shares is public domain and freely available online (though much of it is little more than folk remedies and wives tales). It's that he fearmongers in his informercials, vilifying traditional medicine and claiming he's cracked the system for the benefit of all. And that's what gets the FTC's attention. As it rightly should. He scares people into buying his books. What they then discover though is the books are really only a teaser themselves. The "complete" information is really only available through a pricey subscription to his website. And on and on. Maybe its time for Trudeau to see the inside of a cell. Or at least a hefty fine. It's clear to me that Trudeau's true motivation isn't better health - its bigger personal profit.
Basho, Colorado Springs, CO (Sent Sep 14, 2007 4:56:49 PM)
Trudeau is sadly, a smart con artist. And a wealthy one at that. The phrase that comes to mind is "caveat emptor". Are we all that dumb that we can't bring ourselves to change the channel when he's hawking his wares?

My mom is reading this book right now, and is trying out the diet. I told her this guy is probably full of it, and it seems the FTC thinks so, as well. I'll probably read the book out of curiosity just to see what this quack says. If nothing else, he convinced my mom to try organic foods, so if nothing else this nut job is getting people to try healthier foods. I can't knock him for that.
Jeremy, Vineland,NJ (Sent Sep 14, 2007 5:03:48 PM)
I bought the book and OMG noone could be expected to do this plan which includes 5 to 15 colon cleansing in the first 30 days and taking a deludge of products which by the way you buy through websites he lists in the book, think he takes a cut of those profits?? In the infomercial he also states there is 1 magic product to use, that is a complete, out and out lie. I will never buy any of his books again!!

Other than the obvious problems with a 500-cal-a-day diet, it causes your body to go into starvation mode, thereby making it hoard anything you eat even more. So your metabolism goes down. People would rather do anything than eat less and get up and move. It never ceases to amaze me the quackery that they'll believe to avoid common sense.
(Sent Sep 14, 2007 5:06:54 PM)
I'm amazed that this guy continues to scam people with his false promises. I recall years ago ( as the article stated) that he was sued by the government for the same type of thing. It is ever so true "Let the Buyer Beware" or "fool me once shame on you, fool me twice shame on me" or "if it sounds to good to be true then is probably isn't"

Well..it nice to see such balance in your choice of who you're going to show here!
Kevin Trudeau is a consumer advocate hero and his way of looking at health and remeidies is truly advantageous to the American public.
But I guess the sheepish people that trust in the FDA, FTC, American Medical Association, ect....deserve what you get.
Take your meds...see where it gets you...or...at least..try the natural approach..and be smart about what you put in your body!

It's about time they went after this charlatan again. What I wonder is why the FDA doesn't step in on similar cases. Maybe the FTC was the right organization for this job, but the FDA should be swooping down like hawks on the makers of "homeopathic" medicines and other equally worthless potions (think about so-called male enhancement pills!) Anyway, as long as this country is populated with people who have no critical thinking skills, infomercials will continue to dominate the airwaves, con men/women will continue to get richer, and millions more will be duped over and over again.

I recall first seeing this huckster a few years ago, pushing a book about improving one's memory. It was obvious hype and oversell, but at least served to lock his face into MY memory. Now whenever I'm channel surfing and come across his smug mug, it's a no-brainer - surf on! I see he's still at it, but why not? The penalties levied thus far are just factored into the cost of doing business. Until and unless the FTC puts a big enough hurt on him he'll be back, like a fungus.
Snake oil salemen never went extinct, they mutated into guys like this. Too bad it's illegal these days to tar and feather 'em and the FTC can't keep up with it all (I know, let's have another tax cut! Look what it did for the FDA and FEMA).
Unfortunately, too many of us remain gullible to an easy way out, even if it's against our better judgement. I've seen it in my own family, with the coral calcium for example. Sounds exotic, easy, and I saw it on TV so it must be good, right? Caveat Emptor!
Ralph, Phila. PA (Sent Sep 14, 2007 5:32:04 PM)
Add one more facet to Mr. Trudeau's racket: claim you are the victim of conspiracy. In his book on natural cures, he spends quite a bit of time crying the blues because of his legal troubles with the feds. While some of his advice was useful, it was/is common knowledge to anyone who has looked into natural health.

In a recent lawsuit the FTC made Kevin Trudeau pay thousands in consumer redress. Many consumers of Kevin's false products have gotten back their money that they have spent on his products.
Finally the FTC had enough of the Kevin Trudeau fraud and proceeded to fine Kevin Trudeau two million dollars for making fraudulent claims about a health product. AS well as the fine the FTC has also banned him from appearing on TV to promote his lies.

The biggest issue this article does not address is that fact that Kevin is a con-artist, a twice-convicted felon. He is just doing his latest, in a very long series, of cons aimed at unwitting and/or desperate victims. He is probably violating a couple of restriction orders from previous run-ins with the cops, FTC and the courts.
If you want to lose weight - go to WW or JC or your Mom or your husband or whomever can help can control over 1) your food intake 2) lack of exercise.

This is disgusting! Even mobidly obese people are given 1,000-1,500 calories a day. If you were to cut down that much, then yes, you would lose some weight. You're body is buring off the stored fat. But, you're also messing up your metabolism. And when you finally start eating 'normal' again, you're going to gain more weight than what you had just lost. It happens to lots of people every day doing traditional diets. Moderation and exercise are the keys to weight loss. And a real lifestyle change is the only way to keep it off.

It's people's desire for that quick fix or magic bullet that keeps Trudeau (and others like him) in business. The magic bullet doesn't exist, but that doesn't keep people from hoping that the next weight loss "cure" will finally be the one.
I find it ironic that Trudeau's supporters use a straw man argument to denigrate Trudeau's critics as being shills for the pharmaceutical companies, when Trudeau's own diet plan asks people to undergo 1 month of daily injections of a hormone that is available only by prescription (HCG, as Middle-aged guy mentions).
As a health care provider, I was recently approached by a patient asking me to help her undergo the Trudeau plan. Knowing nothing about Trudeau beforehand, I was appalled as I reviewed the plan at the pseudo-science being used to support Trudeau's claims. There really is no objective basis for claiming that HCG injections and every-other-day colonics are helpful for weight loss. If anything, this kind of thing might actually be harmful for some people, and I told the woman so.
I'm sure I'm going to be accused of being a big-pharma patsy, though I do feel obligated to point out the Trudeau supporters' snide references to erectile dysfunction meds as another straw man argument, as those meds really have no specific role in weight loss. For what it's worth, I rarely write prescriptions for weight-loss meds, whereas I _do_ discuss diet and exercise with multiple patients on most days. Changing your lifestyle is still the way to go; this means making long-term changes in diet and exercise, rather than expecting a 30-90 day program to offer a permanant cure for being overweight.

Never read his book. However, having worked at a vitamin company I know that the government does not want you to have natural cures. If everyone knew that they could grow a plant that would heal an ailment they would not make any money in taxes. The pharmaceutical industry is set up to help you get through your sickness but never heal you completely. For example, if you have a headache and a white willow tree you could just go get some of the bark and eat it. It turns into aspirin after your stomach and does not cause the problems some people have with aspirin.
